Terms and Conditions
These are the terms for getting a website from Dapper Cactus Media. They are written to be read, not skimmed. If anything is unclear, email help@dappercactus.com and ask.
1. Who we are
Dapper Cactus Media is a web design and hosting business in Lubbock, Texas, owned by Justin. In these terms, “we”, “us” and “Dapper Cactus” mean Dapper Cactus Media. “You” means the person or business getting the website. By asking us to build a site, trying it out, or subscribing, you agree to these terms.
2. The offer
- We design and build your custom website. The design is free.
- Your domain name is free.
- You live with the finished site for 7 days.
- Love it: keep it for $89 a month, a limited-time price that is locked in for as long as you subscribe (section 5). That covers hosting, updates, maintenance and support.
- Not for you: walk away and owe nothing.
- We do not sell hosting on its own. We only host websites we design.
3. What we build
We design the site from scratch around your business, with as many pages as it needs. We register a domain for the site, or set up one you already own if that is what you want. We put the site live on our hosting and keep it there while you are a subscriber.
To build it, we need things from you: text, photos, your logo, and answers to our questions. The faster those arrive, the faster the site does.
4. The 7-day trial
The 7 days start when Justin sends you the site as completed, by email. They do not start while the site is still being built.
During those 7 days you can ask for up to 2 revisions. A revision is one list of changes sent together. Once you start paying, revisions are unlimited (section 6), so if you want more changes before the 7 days are up, you can start your subscription early.
If you do not subscribe by the end of the 7 days, we take the site offline and you owe nothing. You can always come back later and ask us to put it up again.
5. Subscription and billing
The subscription is $89 a month, billed through Stripe. Stripe charges your card on the day you subscribe and on the same day each month after that, until you cancel. Stripe handles your card details; we never see your full card number.
If a charge fails, Stripe retries it and we email you. If the balance is still unpaid 7 days after that email, we may take the site offline until it is paid. A suspended site is not a cancelled subscription; cancelling is described in section 7.
Your price is locked. $89 a month is a limited-time price. The monthly price you sign up at stays the same for as long as your subscription stays active, and we will never increase it for you. This holds even if we later change our price for new subscribers or update these terms (section 17). If you cancel and later subscribe again, the price on offer at that time applies.
Apart from your locked monthly price, if we change anything else you pay for, such as adding a new paid add-on, we will email you at least 30 days before the change applies. If you do not want it, cancel before it takes effect.
6. Hosting, updates, maintenance and support
While you subscribe, we host the site, keep it maintained, and make the content changes you ask for. Revisions are unlimited for subscribers, within reason: a new page, new photos, a changed phone number or a reworked section are all fine. A completely new website is a new project, and we will say so before starting it.
Support is by email at help@dappercactus.com. We make reasonable efforts to keep the site up and fast, but no host can promise a site will never go down, and we do not guarantee uptime.
7. Cancelling
You can cancel at any time, two ways:
- Email help@dappercactus.com and say you want to cancel.
- Use the “cancel subscription” option in your online account menu (the Stripe customer portal).
Cancellation takes effect at the end of the month you have already paid for. We do not charge you again after that.
8. Who owns the site and the domain
The website files and the domain name become your property after you have been a subscriber for 1 year. Until then, Dapper Cactus owns them. Once that year is up, ask and we will hand over the site files and transfer the domain to you.
If you cancel before the year is up, we take the site offline and the domain stays with Dapper Cactus. Your own content is always yours (section 9), and you keep it.
Our tools, our name, the cactus mascot and anything we reuse across many sites stay ours in every case.
9. Your content
Everything you give us for the site, such as text, photos, videos, your logo and your business name, stays yours. You confirm that you own it or have permission to use it, and that it does not break anyone’s rights or the law.
You give us permission to copy, edit, display and host that content for the purpose of building, running and promoting your website, for as long as we host it, and in our portfolio as described in section 11.
10. Acceptable use
The site may not be used for anything illegal, or to host or send malware, spam, scams, harassment, or content that infringes someone else’s rights. If it is, we may remove the content or take the site offline, and we may end the agreement (section 15).
11. Portfolio
We may show your site in our portfolio and marketing: screenshots, your business name, and a link to the site.
12. Third-party services
Your site depends on services we do not run: Vercel for hosting, Stripe for billing, FormSubmit for the contact form, domain registrars, and our email provider. Their own terms apply to them. If one of them has an outage, we will do what we reasonably can, but we are not responsible for their failures.
13. Limits on our liability
We are not liable for indirect or consequential losses, such as lost sales, lost profits or lost data, arising from the site, the hosting or these terms. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. The site, hosting and support are provided as described in these terms and otherwise without warranties of any kind, to the extent the law allows.
14. Your responsibility to us
If a third party makes a claim against us because of content you gave us, how you use the site, or a breach of these terms by you, you agree to cover our costs and any damages from that claim.
15. Ending the agreement
We may end the agreement and take the site offline if you break these terms, if the subscription stays unpaid, or if the site is used in a way described in section 10. We will give you notice by email where we reasonably can. Section 8 says what happens to the site and the domain.
16. Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Lubbock County, Texas.
17. Changes to these terms
We may update these terms. The current version is always on this page, with the date at the top. If a change matters to subscribers, we will email you at least 30 days before it takes effect. No change to these terms will raise your locked monthly price (section 5).
